The Colorado’s Protections for Delivery Network Company Drivers Act (PDNCD)

The state of Colorado’s Protections for Delivery Network Company Drivers Act (PDNCD) went into effect on January 1, 2025. PDNCD provides the following rights when performing services in the state of Colorado:

  • Offer transparency, including upfront information about guaranteed minimum earnings, estimated tips, number of packages and delivery stops, and estimated travel distance and time.
  • Pay transparency, including block offer receipts and quarterly mileage reports.
  • Terms of Service transparency, including making the Terms of Service available in the following languages: English, Spanish, Arabic, Amharic, Swahili and Nepalese.
  • Account deactivation transparency, including a clear deactivation policy, written notice of deactivation with reasoning, and the right to appeal the deactivation.

How do I know if a delivery block is covered by the PDNCD Act?

PDNCD applies when performing services in the state of Colorado. For Amazon Flex, this includes delivery blocks with at least one pick-up or delivery stop in the state of Colorado.

Offer Transparency

What additional information will I see about offers covered by the PDNCD Act?

The Amazon Flex app will show you offers for available delivery blocks, which you can view and schedule from the Offers page. Under PDNCD, you are entitled to certain upfront information when an offer is presented to you. For pre-scheduled blocks, this includes your guaranteed minimum earnings, package pickup address, block start time, estimated block duration, and approximate geographic locations of stops. For Instant Offers, you’ll receive detailed information including your guaranteed minimum earnings, estimated tip amount*, and approximate geographic locations of stops. You’ll also see the estimated travel distance and time for the route. You can find this information in the Offer Details screen for pre-scheduled delivery blocks and offer screen for instant offers. For pre-scheduled delivery blocks, some of this information may not be available when the offer is presented to you. In this case, we will provide an update as information about your route becomes available when you arrive at the delivery station.

*For each delivery block that allows tips, we display an earnings range based on the amount of tips that Amazon Flex delivery partners received for similar delivery blocks recently completed in your region. In addition, for delivery blocks covered by PDNCD, you may also see information about tips which customers have already indicated, if any. Customers have up to 24 hours to finalize their tip amount and are not required to tip. When they do, you always receive 100% of the tips.

Pay Transparency

What information will I see about offers covered by PDNCD?

For delivery blocks covered under PDNCD, you have the right to receive an offer receipt that includes offer details, engaged time and miles, and itemized payment information within 24 hours of delivery block completion.

How is engaged time calculated?

For pre-scheduled delivery blocks, engaged time starts when you check in at the delivery station to start your delivery block, and ends when you deliver or attempt to deliver your last assigned deliverable. If your check-in at the delivery station is delayed by Amazon Flex, your time delivering will begin at the time your delivery block was scheduled to start. For instant offers, engaged time starts when you accept the offer and ends when you deliver or attempt to deliver your last assigned deliverable. Engaged time excludes any time not spent delivering. How are engaged miles calculated?

Engaged miles are the distance you traveled during your engaged time. If you have any questions about your engaged miles, please email Driver Support at Amazonzonflex-support@amazon.com using the same email address associated with your Amazon Flex account.

Where can I find my offer receipt?

You can view and download the receipts in the Amazon Flex Colorado Receipts Portal. Please use your Amazon Flex account credentials to sign-in. To view and download receipts from the Amazon Flex app, please navigate to the Learning Portal > Earnings and taxes > Colorado offer receipt and mileage report. If you need assistance logging in to the Amazon Flex app, please email Driver Support at amazonflex-support@amazon.com using the same email address associated with your Amazon Flex account.

What information will I see in the quarterly mileage report?

For delivery blocks covered under PDNCD, you have the right to receive a quarterly mileage report that includes a summary of your engaged mileage during the previous quarter. In addition to your engaged mileage, the report will also include the applicable IRS mileage rate for that quarter.

Terms of Service Transparency

How can I view the Amazon Flex Terms of Service?

The Amazon Flex Terms of Service is available in the following languages: English, Spanish, Arabic, Amharic, Swahili and Nepalese.To view, navigate to Settings > View Legal Information > Independent Contractor in the Amazon Flex app.

Updates to the Terms of Service are made available in-app, and sent to you via email, at least 14 days' prior to any changes taking effect.

Account Deactivation Transparency

What is Amazon Flex’s deactivation policy?

Amazon Flex’s deactivation policy is available in the following languages: English, Spanish, Arabic, Amharic, Swahili and Nepalese.

Do I have an option to appeal if my Amazon Flex account is deactivated?

Under PDNCD, if you are deactivated, you have the right to receive written notice detailing the reason for deactivation and the effective date of the suspension or termination and any steps you can take to appeal the decision.

You have the right to appeal the decision within 30 days of receiving the deactivation notice. Amazon Flex will review your appeal and respond within 14 days, either reaffirming the deactivation or reinstating your access. If Amazon Flex determines that no policy violation occurred or that the violation has been corrected, your access will be reinstated within 72 hours of the decision.
